Service Level Agreement
I. QUOTES AND GUARANTEED OFFERS 1. Quotes are valid for 14 days from the date of issue. Items must arrive at Jay Brokers on or prior to the expiration date. Items received after the quote expiration date are subject to reevaluation. 2. Quotes are non-negotiable. Most items over $250 are valued at 70-80% of current Fair Market Value (FMV). Generally, most items under $1,000 are valued at 70% of FMV, whereas items over $1,000 are valued at closer to 80% of FMV. 3. Quotes are guaranteed provided the item received is the same as described in the customer's original quote request. If the item received is not the same as described, the quote will be reevaluated based upon the item received. If a reevaluation is completed, customers have the option to accept an adjusted quote or Jay Brokers will return the item to the customer free of charge via UPS Ground. 4. Bonus referral offers are only valid provided the referral voucher or coupon is provided by the customer at the time of receipt. All vouchers and coupons are subject to approval and authorization. 5. All customers must be 18 years of age and older. Jay Brokers is unable to issue guaranteed offers or conduct business with any minor under the age of 18. II. PROPERTY 1. Customers must hold full legal ownership of any items sent to Jay Brokers. Jay Brokers is unable to accept stolen goods or items from third parties without consent and/or proof of ownership. 2. Serial numbers and other identifying information are processed through state and national databases of stolen property. All items identified as stolen property will be handed over to the appropriate law enforcement. Customer contact information will be provided to law enforcement upon an authorized request. 3. Items sent to Jay Brokers become property of Jay Brokers upon receipt and exchange of payment, typically within 24 hours or less from the delivery date and time. III. PAYMENTS 1. Payments are sent within 24 hours of receiving your item during normal business hours (Monday-Friday, 9 A.M.-6 P.M., excludes weekends and holidays). 2. Payments sent by U.S. First Class Mail do not include tracking information, delivery confirmation, or a guarantee of delivery time. If you do not receive payment within 14 days of notification, please contact Jay Brokers and the check will be re-issued. 3. Payments sent by UPS Next Day Air will incur a shipping cost of $20-$30 deducted from the check total. The shipping cost is calculated based on the destination zip code directly from UPS published rates. 4. Jay Brokers is unable to use third party account numbers for shipping charges. 5. Payments sent by PayPal must be sent to the customer's e-mail address. Jay Brokers is unable to send PayPal payments to third parties. 6. Payments sent by UPS Next Day Air and PayPal are only valid on net transactions under $2,500. 7. Bonus referral payments are sent to referring customers within 48 hours of the completion of the new customer's first transaction. Referral payments are sent as checks via U.S. First Class Mail or electronic PayPal payments. IV. SHIPMENTS 1. Customers are responsible for shipping items to Jay Brokers. This includes but is not limited to packaging, shipping, and handling costs. 2. Although Jay Brokers is not responsible for packages lost or damaged in transit, we will attempt to cooperate in resolving shipping and insurance claims. V. VALUATION 1. Items containing an excess of odor such as cigarette or tar odor are subject to a 15% reduction of the original guaranteed offer. 2. Items must be designed for distribution in the United States. Jay Brokers is unable to broker foreign goods or items not designed for use in the United States. This includes items with non-U.S. keyboard layouts, non-U.S. warranties, or non-U.S. licenses. 3. Jay Brokers is unable to offer additional value for software without original installation CD's, product keys, certificate of authenticities (COAs), or other documents necessary for proper licensing. 4. Jay Brokers is unable to offer additional value for OEM, volume, or academically licensed software. 5. The customer is responsible for disclosing defects or imperfections including but not limited to missing or damaged parts that hinder the functionality or aesthetic appearance of an item. Unless noted, Jay Brokers assumes chargers, batteries, power supplies, and other parts required for basic functionality are included with an item. 6. If the customer fails to provide adequate specifications for an item and Jay Brokers makes disclosed assumptions, the customer is responsible for verifying the disclosed assumptions (customers will see a note in their quote if assumptions have been made). Failure to verify disclosed assumptions (if they are incorrect) may result in an adjusted offer upon receipt of an item. 7. Items missing serial numbers, ESNs, service tags, certificate of authenticities (COAs), BIOS passwords, or other unique identifying information must be disclosed to Jay Brokers upfront with reasonable explanation. Jay Brokers reserves the right to deny quotes to such items. 8. Cell phones and subscription based wireless products must have unregistered ESNs. Items received with ESNs reported as lost or stolen will be transferred to an authorized representative of the applicable wireless carrier (Sprint, Verizon, etc.). VI. SECURITY AND PRIVACY 1. Customers agree not to interfere with the eBay selling process executed by Jay Brokers by engaging in unethical activities including but not limited to bid shilling, phishing scams, or other adverse activities prohibited by eBay policies. 2. Jay Brokers respects your privacy by not reselling or distributing your personal information to any third party. All personal information is stored on secure servers protected by password access given only to authorized Jay Brokers employees. 3. Upon authorized requests from law enforcement, Jay Brokers complies by supplying law enforcement with requested customer information and related transaction data. 4. All items received at Jay Brokers undergo a standard data erasing process to ensure removal personal and private customer information. 5. Customers will receive one to three follow-up responses to any direct e-mail or phone request. Customers can request to be removed from future follow-up contact at any point in time. 6. Jay Brokers may send a maximum of one e-mail update or newsletter to customers each quarter, a maximum of four times per year.
